Laicità

Il decreto di concessione della cittadinanza italiana è un
provvedimento ampiamente discrezionale, adottato
dall’Amministrazione sulla base di valutazioni aventi ad oggetto –
tra gli altri – il requisito dell’avvenuta integrazione dello
straniero in Italia. Nel concedere il provvedimento in questione,
tuttavia, l’Amministrazione non può basare il proprio eventuale
diniego su elementi relativi a scelte e convinzioni di natura
personale del richiedente, le quali non possono formare oggetto di
alcuna valutazione da parte della stessa (Nel caso di specie, il
Ministero dell’Interno aveva negato il decreto di concessione della
cittadinanza in considerazione dell’attaccamento, del richiedente,
ai valori della cultura del paese di provenienza).
